Acceptance of These Terms

These Terms of Service form an agreement between you and DRT Workwear LLC, a workwear stockroom located at 1358 S 500 E, Salem - 84653-5300, United States (US). By using this website, by submitting an enquiry or by placing an order with the stockroom, you agree to these terms. If you do not agree, please do not use the website and please do not place an order.

These terms should be read together with our Privacy Policy, which explains how we handle personal information. Where an order is confirmed in writing with a separate quotation, a separate work order or a signed crew supply agreement, the additional document applies alongside these terms for that order. If those documents conflict with these terms, the additional document controls for the specific order it covers.

Definitions

In these terms, the words we, us and our refer to DRT Workwear LLC. The words you and your refer to the person or business using the website or placing an order. The word stockroom means our supply premises at the address given above. The word garments means coveralls, overalls, hi-vis layers and any other workwear supplied by us. The word artwork means any logo, text or image that you provide for stitching.

An order means a request for garments, stitching or a crew supply program that we accept in writing. A crew uniform program means an ongoing arrangement to hold stock, stitch logos and refill garments for a named team. A seasonal layer exchange means the planned swap of heavier and lighter layers as the year turns.

Eligibility and Business Use

The website and the stockroom services are intended for businesses and adult workers. By placing an order, you confirm that you are at least eighteen years old, that you have the authority to act for the business you represent and that the information you provide is accurate. If you place an order on behalf of a team, you confirm that you have the right to share the roster details needed to fit, stitch and deliver the garments.

We supply trade teams, contractors and employers. We do not knowingly supply accounts that are opened to resell our stitching services under another name without agreement. If we believe an order is being used contrary to this section, we may decline the order or ask for clarification before we begin work.

Orders and Quotations

An enquiry, a quotation or a message through the contact form does not create a binding order. An order is accepted only when we confirm it in writing, usually by email, after we have checked the stock, the sizes, the artwork and the requested date. We may decline an order where a garment is unavailable, where the artwork cannot be stitched cleanly or where the request cannot be met within a reasonable time.

You are responsible for checking the details in a confirmation, including the sizes, the quantities, the garment type, the logo placement and the delivery point. If something is wrong, please tell us promptly so that we can correct it before the run begins. Once a stitching run has started, changes may not be possible and a change to a confirmed order may delay the delivery date.

Where a crew list is supplied, you are responsible for the accuracy of that list. If a worker has joined, left or changed size, please send an updated list before the order is confirmed. We will do our best to fix a late change, but we cannot guarantee that a garment already stitched for a previous size can be altered without additional cost.

Pricing and Payment

Prices are given in the quotation and are valid for the period stated in that quotation. Unless a quotation says otherwise, prices do not include taxes or delivery charges, which are added where applicable. We may revise a price if the cost of a garment, a thread or a delivery changes materially before an order is confirmed, and we will tell you before any revised price is applied.

Payment terms are stated on the invoice. For a first order we may ask for a deposit before a stitching run begins. For a crew uniform program we may agree a regular billing cycle. Late payment may pause a refill or a seasonal exchange until the account is settled. If a payment is disputed, please tell us before the due date so that we can look into it rather than let the account fall behind.

All invoices are issued in the currency stated on the invoice. You are responsible for any bank charge that applies to your chosen payment method. We do not store full payment card details on the stockroom systems, and we ask that you do not send card details by email.

Logo Artwork and Stitching

You are responsible for the artwork you send and for having the right to use it. By sending artwork, you confirm that you own it or that you have permission from the owner to have it stitched onto garments. We may refuse artwork that appears unlawful, offensive or likely to infringe the rights of another business, and we will explain the reason for a refusal where we can.

Stitching is a physical process, and small variation is normal. The shade of a thread, the density of a stitch and the exact position of a mark can vary slightly between garments and between runs. We check each mark against the artwork before a garment leaves the bench, and we will correct a clear fault at no cost. We cannot reproduce a photograph or a very fine detail beyond the practical limits of a stitch, and we will tell you if an artwork needs to be simplified before a run begins.

Where we hold artwork for a crew program, we use it only to fulfil your orders. We do not sell or reuse your artwork for another customer. You can ask us to delete a stored artwork file when a program ends, and we will do so unless a record must be kept for a billing or legal reason.

Delivery and Collection

Delivery dates are estimates unless we expressly confirm a fixed date in writing. We will make reasonable efforts to deliver on time, but a delay caused by a carrier, a supplier or an event outside our control does not entitle you to cancel an order that has already been stitched unless the delay is substantial and we cannot offer an alternative.

You are responsible for giving us an accurate delivery point and for making sure that someone can receive the garments. If a delivery cannot be made because the site is closed or the address is wrong, a further delivery charge may apply. Risk in the garments passes to you on delivery, and ownership passes when the invoice is paid in full. Please check a delivery on arrival and tell us about any shortage or visible damage within a reasonable time.

Returns and Faulty Garments

Because crew garments are often stitched to order, a return is not automatic once a logo has been applied. If a garment is faulty, if the wrong item was sent or if a size does not match the confirmed order, please tell us promptly and we will arrange a repair, a replacement or another fair solution. We may ask for a photograph or for the garment to be returned so that we can inspect it.

A garment that has been damaged through misuse, through a wash instruction that was not followed or through normal wear after a reasonable period is not faulty. A garment that no longer fits because a worker has changed size is not faulty either, but we can usually help through a refill or a layer exchange. Nothing in this section limits a right that applicable consumer law gives to an individual buyer and that cannot be excluded.

Crew Uniform Programs

A crew uniform program is an ongoing arrangement rather than a single order. When a program begins, we agree the roster, the standing stock, the refill rhythm and the way that changes are reported. You are responsible for keeping the roster current and for telling us when a worker joins, leaves or changes size. We are responsible for holding the agreed stock and for refilling the gaps on the agreed schedule.

A program may be paused or ended by either party with reasonable notice. When a program ends, we will settle any open invoices, arrange the delivery of any held stock that you have paid for and delete a stored roster where no legal or billing duty requires us to keep it. Stored artwork is handled in the same way. If a program is paused for a long period, we may release held stock back to the shelf after telling you.

Seasonal Layer Exchanges

A seasonal layer exchange is planned around the crew calendar and the weather that a shift is likely to meet. Returned heavy layers are checked, cleaned and counted before they rejoin the stock. A garment that is beyond repair is retired from the exchange, and we will tell you when a replacement is needed so that you can approve it.

An exchange date is confirmed in writing. If a crew needs an earlier exchange, please tell us as soon as possible and we will do our best to bring it forward, though a short notice change may depend on stock. A garment that is lost rather than returned is treated as part of the crew holding and may be charged to the program. We keep a simple record of each exchange so that the next one is accurate.

Bulk Trade Orders

Bulk trade orders are handled with the same care as smaller orders, but they carry additional planning requirements. A bulk order is sorted by site, stitched in planned batches and checked against a site name before delivery. You are responsible for giving us an accurate split of quantities by site and for telling us if a site start date changes. If one site starts earlier, we will try to split the delivery so that the first crew is not delayed.

Because bulk work uses more stock, we may ask for a deposit or for a confirmed payment schedule before a run begins. A bulk order that is cancelled after stitching has started may be charged for the work already completed and for any garment that cannot be returned to the shelf. We will explain any such charge clearly before the order is closed.

Acceptable Website Use

You may use this website to learn about our services and to contact the stockroom. You must not attempt to gain unauthorised access to the website, interfere with its normal operation, upload malicious code or use an automated tool to copy the content at a volume that places a load on our hosting. You must not misrepresent your identity when contacting us or place an order using information that you do not have the right to use.

We may suspend access to the website for maintenance or for a security reason. We will try to keep any interruption short, but we do not promise that the website will be available without interruption. If the website is unavailable, you can still reach the stockroom by telephone at +16319083631 or by email at uniforms@drtworkwear.lat.

Intellectual Property

The content of this website, including the text, the layout and the design elements that we created, belongs to DRT Workwear LLC and is protected by applicable intellectual property law. You may read, print and share a page for the purpose of learning about our services or placing an order. You must not copy the website content into another business site or present it as your own without our written permission.

The logos and trade names of our customers remain the property of those customers. We use customer artwork only to fulfil an order, as described in the stitching section above. If you believe that content on this website infringes a right that you hold, please contact us with the details and we will look into it promptly.

Third Party Links and Tools

This website may include a link to a third party service, such as a map or an email provider, for convenience. We do not control those services and we are not responsible for their content or their practices. A link does not mean that we endorse the third party. If you choose to use a third party service, you do so under that service own terms.

Where we use a third party tool to send an email or to process an invoice, we remain responsible for choosing a provider with reasonable safeguards. Our Privacy Policy describes how information is shared with those providers. We are not responsible for an outage of a third party tool, though we will try to offer an alternative way to reach the stockroom during an outage.

Limitation of Liability

To the extent permitted by law, DRT Workwear LLC is not liable for an indirect or consequential loss, for a loss of profit, for a loss of business or for a loss that was not reasonably foreseeable when the order was confirmed. Our total liability for an order is limited to the amount that you paid for the garments or the service that gave rise to the claim, unless a law sets a different minimum that cannot be excluded.

Nothing in these terms excludes liability for fraud, for death or personal injury caused by negligence or for any other liability that cannot lawfully be excluded. We supply garments that are intended for their stated use, and a worker should always follow the care label and the site safety rules. A garment is not a substitute for the safety equipment required by a particular workplace.

Indemnity

You agree to indemnify DRT Workwear LLC against a reasonable loss, claim or cost that arises because you sent artwork that you did not have the right to use, because you gave us inaccurate roster or delivery information, or because you used the website in a way that breached these terms. This indemnity applies only to the extent that the loss is caused by your own act or omission and does not cover a loss caused by our own negligence.

Privacy and Data

Our Privacy Policy explains how we collect and use personal information. It forms part of the way we work with you, and you should read it together with these terms. Where you share a crew roster with us, you confirm that you have a lawful reason to share the information and that the workers have been told what information is passed to the stockroom.

If a data protection question arises during a crew program, please raise it with the same contact who manages the program. We will work with you to answer a worker request, to correct a record or to remove information that is no longer needed. We will not disclose a roster to another customer, and we will keep the roster separate from any marketing list.

Suspension and Termination

We may suspend an order or a crew program if an invoice remains unpaid after the due date, if we cannot verify the authority of the person placing the order or if we reasonably believe that an order is being used for an unlawful purpose. We will tell you the reason for a suspension and what is needed to resolve it. A suspension does not remove an obligation to pay for work already completed.

Either party may end a crew program with reasonable written notice. An order that has already been confirmed and stitched will still be delivered and invoiced unless we agree otherwise. Sections of these terms that by their nature should survive the end of an agreement, such as the sections on intellectual property, limitation of liability and governing law, continue to apply after the agreement ends.

Governing Law and Disputes

These terms are governed by the laws that apply at the place where DRT Workwear LLC operates, without regard to a conflict of law rule that would point to another law. If a dispute arises, we ask that you contact us first so that we can try to resolve it directly. Most questions about an order can be settled quickly with a call to +16319083631 or a clear email to uniforms@drtworkwear.lat.

If a dispute cannot be resolved by discussion, either party may bring the matter before a court or another forum that has lawful jurisdiction. Nothing in this section prevents a party from asking a court for urgent relief where that is necessary to protect a right. If any part of these terms is found to be unenforceable, the remaining parts continue to apply.

Changes to These Terms

We may update these terms from time to time to reflect a change in our services, in the law or in the way we operate the stockroom. When we make a material change, we will update the effective date at the top of this page and, where appropriate, tell regular customers directly. An order that is already confirmed will continue to be governed by the terms that applied when it was accepted, unless the change is required by law.

We encourage you to check this page before placing a new order so that you know the terms that will apply. If you do not agree with an updated term, you can choose not to place a further order, and you may end an ongoing crew program with reasonable notice as described above.
